1. The subject of the contract is the design and construction of an extension of the S1 expressway on the section from km 549+830.00 to km 554+570.00. The above section is a part of the S1 expressway connecting the existing route of the S1 from the Pyrzowice interchange to the Brzęczkowice interchange with the constructed section of this road from the Kosztowy II interchange to Bielsko-Biała. The contract is carried out in the design and build formula. 2. The detailed description of the subject of the contract is provided in Volume III -V of the SWZ. 3. The contracting authority reserves the obligation for the Contractor to personally perform key tasks, i.e., the main route surface including production and installation, as well as the execution of other pavement layers above the native ground (excavation) or embankment (embankment), excluding the supply of materials and services. Regarding key tasks reserved for personal execution by the Contractor, the Contractor cannot rely on the capabilities of the resource-providing entity, based on the principles set out in art. 118 sec. 1 of the Public Procurement Law, to demonstrate compliance with the relevant participation conditions in the procedure. 4. The order referred to above is an order with a value exceeding the equivalent amount in Polish zlotys for construction works, i.e., 20,000,000 euros.
